The Amicus Curiae Committee has the delegated authority to identify appropriate cases for amicus submission addressing access to justice issues. In October 2020, the Amicus Curiae Committee sought, and the California Supreme Court granted, permission to file an amicus curiae brief in In re A.R. (Alameda County Social Services Agency v. M.B.), S260928. The access issue presented is that a mother’s parental rights were terminated and her appointed lawyer missed the deadline to appeal. The Supreme Court will decide whether to apply the constructive filing doctrine and allow an appeal. The Amicus Curiae Committee’s brief argued in favor of doing so under conditions that apply in that case.
